Terms and conditions

1. Scope

(1) These terms and conditions apply to all orders placed by consumers in the online shop zydante.com with Homeshopping24 B.V., Jan Tademaweg 40, 2031 CV Haarlem, the Netherlands ("Zydante", "we" or "us").

(2) A consumer is any natural person who enters into a contract for purposes that are mainly outside their trade, business or profession.

(3) Different terms of the customer do not apply unless we expressly agree to them.

2. Contracting party, language

(1) The contract of sale is concluded with Homeshopping24 B.V. (see our legal notice for contact details).

(2) The language of the contract is the language in which you place your order (English, Dutch or German).

3. How the contract is concluded

(1) The products shown in the online shop are not a legally binding offer but an invitation to order.

(2) You can add products to your basket and enter your details during checkout. Before you submit your order, you can check all details and correct them using the "back" function or by editing the input fields. By clicking the order button, you make a binding offer to buy the goods in your basket.

(3) Immediately after submitting your order, you receive an order confirmation by email. With this confirmation we accept your offer, and the contract of sale is concluded.

(4) We store the contract text. You receive the order details with the order confirmation by email. You can view and print these terms on this page at any time.

4. Delivery

(1) We deliver to the countries offered as delivery country at checkout. Beds, box springs and mattresses are delivered in the Netherlands and Belgium only.

(2) Shipping costs depend on the delivery country and are shown at checkout before you place your order. More information is in our shipping policy.

(3) We dispatch your order within 2–4 working days after the contract is concluded. Different delivery times are shown on the product concerned.

5. Prices and payment

(1) Prices are shown in the currency of your delivery country and include VAT where applicable, plus shipping costs where applicable under section 4. For deliveries to countries outside the EU, import VAT and customs duties may apply.

(2) The payment methods shown at checkout are available. The purchase price is due when the contract is concluded.

6. Retention of title

The goods remain our property until they have been paid for in full.

7. Right to cancel and voluntary return guarantee

(1) Consumers have a legal right to cancel. The details are set out in our returns policy under "Your right to cancel".

(2) In addition, we offer a voluntary return guarantee of 90 days after receipt of the goods. Your legal rights, in particular the right to cancel and your rights if goods are faulty, are not affected.

8. Faulty goods

Your statutory rights for faulty goods apply. Please check the goods on receipt and tell us about obvious transport damage as soon as possible at customerservice@zydante.com. Not doing so does not affect your statutory rights.

9. Dispute resolution

We are not willing or obliged to take part in dispute resolution proceedings before a consumer arbitration board.

10. Applicable law

Dutch law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive you of the protection given by mandatory provisions of the law of the country where you have your habitual residence.
